Terms of Use

Welcome to Desert Adventures. These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Desert Adventures Tourism LLC (“Desert Adventures,” “we,” “us,” or “our”), governing your access to and use of our website, mobile site, and associated booking services, collectively referred to as the “Platform.”

By accessing, browsing, or using our Platform, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use or access our Platform.

1. Eligibility

You must be at least 18 years of age and possess the legal authority to enter into binding agreements in order to use this Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are accessing the Platform on behalf of another person or entity, you warrant that you are duly authorized to accept these Terms on their behalf.

2. Scope of Services

Desert Adventures provides destination experiences through an online booking platform that allows users to discover, reserve, and purchase travel-related services, including but not limited to excursions, tours, activities, transfers, and related offerings (collectively, “Services”). The Services are available in the Middle East, subject to availability.

Our Platform lists Services operated either by third-party suppliers (“Suppliers”) or directly by Desert Adventures. Desert Adventures acts as an intermediary for third-party Services and as a direct provider for certain Services operated under our brand.

3. Account Registration

To access certain features of the Platform or make a booking, you may be required to create a user account. You agree to provide truthful, accurate, and complete information during the registration process and to maintain the accuracy of such information at all times. You are solely responsible for safeguarding your account credentials and for any activities conducted through your account.

4. Booking and Payment Terms

All bookings made via the Platform are subject to availability and final confirmation. Prices displayed are in United States Dollars (USD) or as otherwise indicated and may include applicable taxes and service fees.

Payment must be made in full at the time of booking unless otherwise specified. Desert Adventures reserves the right to cancel any booking in the event of payment failure, suspected fraud, or misrepresentation.

5. Modifications, Cancellations, and Refunds

Each Service is subject to specific cancellation and refund policies, which will be displayed at the time of booking and stated in your booking confirmation. These policies vary depending on the Service and the provider.

Desert Adventures reserves the right to cancel or modify any booking in case of unforeseen circumstances, operational limitations, regulatory changes, or force majeure events. In such cases, we will offer either a full refund or an equivalent alternative, at our discretion.

6. User Conduct

You agree not to use the Platform or Services:

• For any unlawful or fraudulent purpose;

• To impersonate another individual or entity;

• To interfere with the security or integrity of the Platform;

• To upload, transmit, or share content that is defamatory, obscene, infringing, or otherwise objectionable.

We reserve the right to suspend or terminate your access to the Platform if you violate these Terms or engage in any conduct that we determine to be inappropriate or harmful.

7. Intellectual Property Rights

All content, including but not limited to text, graphics, photographs, logos, software, and trademarks appearing on the Platform, is the property of Desert Adventures or its licensors and is protected by applicable intellectual property laws. No content may be copied, distributed, republished, or otherwise exploited without our prior written consent.

8. Disclaimer of Warranties

The Platform and all Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Desert Adventures disclaims all warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

9. Limitation of Liability

Desert Adventures acts both as an intermediary and, in certain cases, a direct operator of Services. While we take reasonable steps to ensure the quality of all listed Services, we do not guarantee the performance of third-party Suppliers.

To the maximum extent permitted by applicable law, Desert Adventures shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform or any booked Services. In all cases, our total liability shall be limited to the amount you paid for the relevant booking.

10. Indemnification

You agree to indemnify, defend, and hold harmless Desert Adventures and its officers, directors, employees, agents, affiliates, and partners from and against any and all claims, losses, damages, liabilities, costs, and expenses arising from:

• Your use of the Platform or Services;

• Your violation of these Terms;

• Any act or omission by you that causes damage or liability to a third party.

11. Force Majeure

Desert Adventures shall not be held liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, technical failures, or government actions.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

13. Changes to These Terms

We may modify these Terms from time to time without prior notice. Your continued use of the Platform following such changes constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, the remaining provisions shall remain in full force and effect.

15. Entire Agreement These Terms, together with our Privacy Policy, constitute the entire agreement between you and Desert Adventures with respect to the use of the Platform and supersede all prior or contemporaneous communications.
